GENERAL CONDITIONS
This Website is operated by Club Leisure Development (Pty) Ltd t/a First Loyalty Plus.
The terms “we”, “us” and “our” refer to a First Loyalty Plus, and the terms “you” and “your” refer to the users of the Website.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
First Loyalty Plus offers this Website, including all information, product, and services available from this Website to you subject to your acceptance of all terms, conditions, policies, and notices stated herein.
By visiting the Website and/or purchasing a product or service from the Website you have engaged in our “Service” and agree to be bound by all terms, conditions, policies, and notices stated herein, as well as any other terms, conditions, policies and notices made available by hyperlink on the website.
These Terms of Service apply to all users of the site including, but not limited to, users who are browsers, customers, members, suppliers, merchants, vendors and contributors of the Website content.
If you do not agree to any of the conditions of this agreement, then you may not access the Website or purchase any of the products or services made available to you by the Website.
The travel section (Hotels, Resorts, Flights, Car Rentals, Cruises, Activities) of the Website is hosted on Leisure Loyalty Inc. and store section of the Website is hosted by the WordPress Foundation. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
We reserve the right to cancel, limit or prohibit purchase from the Website that, in our sole judgment, appear to be placed by dealers, distributors or resellers. These restrictions may include purchase placed by or under the same account, purchases using the same credit card, and/or purchases that have the same billing/shipping address. In the event that we make a change to or cancel a purchase, we will notify you via the email address and/or cell phone number associated with your account.
MEMBERSHIP
In order to make any purchase from the Website you first need to be registered as a member of the Website.
At the time of registration, you must provide a valid email address and cell phone number and create a member password. Your email address will serve as your username for the Website and various services provided by the Website. Your cell phone number will serve as your username for various other services provided by the Website. Your email address, cell phone number, and password are unique to you and are necessary to creating a membership on the Website. A particular email address or cell phone number can only be used once in connection with a single membership account.
Your personal information (not including credit card information), may be transferred unencrypted and involve transmissions over various networks, and may be altered to conform to the technical requirements of the various networks. Credit card information is always encrypted all will on be transferred to a First Loyalty Plus nominated payment gateway.
You must be at least the age of majority in your country of residence to use this Website, or that you are the age of majority in your country of residence and you have explicitly consented to allow any of your minor dependents to use this Website;
You must be the holder of a valid credit card or debit card capable of performing online transactions or have the explicit consent from the holder of a valid credit card or debit card capable of performing online transactions, in order to use this Website.
You cannot have more than one membership account. Memberships can only be used by the member whose name is listed on the account. You are responsible for the activity of another person, regardless of relationship, using your membership account.
In order to earn and redeem Rewards, you must be registered as a paying member.
PAID MEMBERSHIP PROGRAM
You may participate in the a First Loyalty Plus paid membership Program to earn Rewards for being a member of the Program and for purchasing products or services available on the Website.
The Rewards you earn will be credited to your account and can then be redeemed for rewards on selected products and services.
All the Program benefits, including the ability to redeem Rewards, are subject to availability of the particular product or service, and there is no guarantee of any continued availability of any particular product or service or the continued availability of any particular redemption or savings opportunity.
Members are individually responsible for any personal tax liability that may arise from participating in the Program or the use of Rewards.
Members are responsible for any additional expenses incurred while using the products or services purchased on the Website including, but not limited to, transportation, meals, gratuities, telephone calls, room service, incidentals, and any related taxes.
Membership does not grant the users any property rights or any other legal interests in or with any of the Website’s suppliers, affiliates, fellow subsidiaries, or any other companies doing business with a First Loyalty Plus.
Membership, including the opportunity to earn Rewards on selected benefits, is offered in good faith but may be made unavailable if prohibited or restricted by applicable laws or regulations in your country of residence.
MEMBERSHIP ACCOUNT
Your welcome email will have directions on how to activate your membership account.
A membership account will be set up to record each member’s activity. We reserve the right to monitor all account activity. If your account shows signs of fraud, abuse or suspicious activity, you may lose your Rewards and your account may be immediately closed or frozen.
If you have been assigned Rewards in error, or if there is any indication that your account has been the subject of any suspicious activity, please contact us immediately.
If your account does not reflect the correct balance of Rewards that should have been assigned to you as determined by us, we reserve the right to adjust your account balance.
On completion of a transaction, if you believe that your account has not been credited with the correct amount of Rewards, then you must inform us within twenty-one days from the date of the transaction and be able to provide proof of such transaction.
The accumulation of Rewards does not entitle you to any vested rights with respect to us or any Program rewards or benefits.
You agree to provide current, complete and accurate purchase and account information for all purchases made on the Website. You agree to promptly update your account and other information, including your email address, cell phone number, credit card number and credit card expiration date so that we can complete your transaction accurately and contact you as needed.
REWARDS
Rewards are the reward currency of a First Loyalty Plus. As long as you are actively enrolled as a paying member, you can use your Rewards on rewards listed on the Website.
Rewards cannot be redeemed for cash.
Rewards are not gift-certificates, credit or debit cards, or prepaid vacation vouchers.
Unless explicitly stated, Rewards cannot be used in combination with any other discounts, certificates, coupons, upgrades, promotions or awards.
Rewards are considered as promotional items, are void if transferred, sold for cash or other consideration or if altered or copied, cannot be reissued if destroyed, lost or stolen, and are invalid where prohibited by law.
Only you may access your account and use your Rewards. Rewards may not be utilized for redemption until they appear as available in your account summary.
Rewards may not be assigned, sold, pledged or transferred to any third party. Upon the death of a member, we will have sole discretion with regard to the transfer of any unredeemed Rewards.
The accumulation, redemption, and expiration of your Rewards may be accessed in the account section of the website once you have logged in.
Rewards expiry after 3 years since the date earned.
REDEEMING Rewards
Rewards can be used to redeem for a host of amazing lifestyle products such as Spa treatments, Designer costume jewellery, luxury accommodation, activities and an awesome selection of goods from our store.
Once the purchase of a reward has been completed, the amount of Rewards redeemed will be deducted from you Rewards account, and you will receive an email with confirmation of your redemption. Any remaining Rewards in your account may then be used for other reward redemptions.
You can continue to use your Rewards until your account balance reaches a zero.
We have the sole right to determine the value and number of Rewards required for any redemption.
The number of Rewards required for any redemption will vary based on the value and demand of the reward.
The number of Rewards required for any redemption is subject to change without notice.
The amount of Rewards redeemed at any given time does not guarantee or imply that the same or similar amount of Rewards will be available for future redemption.
Completed reward redemptions cannot be changed or refunded once the order has been fulfilled and the products or vouchers have been shipped or emailed
EARNING REWARDS
Some membership types receive an initial allocation of Rewards upon activation.
The Rewards for reservations will be credited to your account immediately upon payment.
The Rewards for the purchase of a product will only be credited to your account once the order has been fulfilled and the product shipped.
On occasion, we may offer opportunities to earn bonus Rewards on a promotional or incentive basis for select purchase opportunities. These offers are temporary in nature and we reserve the right to modify or discontinue any such offers at any time. Such offers are void where prohibited by law.
If a particular supplier opts out of the Program, then any Rewards previously earned with that supplier will still be honoured by us, however, that supplier’s services and/or products will no longer be available for future earning or redemption of Rewards.
CRAVE DINING & COFFEE DISCOUNTS
As a paying member of the Program, you are entitled to the various Crave Dining & Coffee discounts.
Crave has the sole and absolute discretion to amend the list of restaurants participating in the Program. We shall endeavour to promptly update our Website as and when any changes are made. Whilst every effort will be made to ensure that all listed restaurants are trading, neither us or Crave, will not be held liable in the event of any restaurant closures.
Neither us or Crave, accept any responsibility for the quality of services and/or meals provide by any of the participating restaurants and, neither us or Crave, will not become involved in any non-Crave related disputes between you and any participating restaurants in relation to the quality of services and/or meal provided by a participating restaurant.
Participating restaurants reserve the right to vary prices, times and availability of the benefit.
CRAVE DINING CASHBACK BENEFIT TERMS AND CONDITIONS:
Refunds are processed by Crave and not the restaurant. Accordingly, please refer all Benefit queries to Crave.
The Dining Cashback Benefit entitles the active member only to a refund (cashback) on the second most expensive meal, provided:
1) no less than 2 meals and 2 drinks are purchased per membership; and
2) they have not exceeded their visits for that month (where applicable); and
3) they are at least 18 years of age
The cashback amount will be calculated as the second most expensive meal on the bill, up to a maximum of R120.00 (one hundred and twenty Rand). The cashback claim will be verified with the restaurant to ensure validity.
The cashback claim will be processed within 4 working days unless otherwise specified. Over the December holiday period, claims will require additional processing time.
The Dining Cashback Benefit:
1) is valid for a specified list of restaurants only. Crave shall be entitled, in their sole and absolute discretion, to amend the list of restaurants from time to time. Crave shall endeavour to promptly update this list as and when any changes are made. Whilst every effort will be made to ensure that all listed restaurants are trading, Crave will not be held liable in the event of any restaurant closures; and
2) is based on the restaurant’s standard prices; and
3) is not applicable in conjunction with any special offers, promotions, discount vouchers or loyalty programmes; and
4) may be used in conjunction with Uber Pass; and
5) may be used for takeaways and delivery where available; and
6) may only be used once per restaurant per day; and
7) does not apply to desserts, toppings, sides, “build your burger”, shareable platters, extras on burgers/pizzas etc.; and
8) applies to courses that include drinks, provided it is not a special; and
9) may not be used within 3 hours of a previous claim.
10) may not be used at any restaurant at which the member is employed.
A maximum of two memberships may be used per table, provided they are under different names. Each member must request their own authorisation and claim separately. In the case of two claims submitted, the first claim processed will attract the bigger discount. The cashback amount will be calculated as follows:
· Membership 1: 2nd most expensive meal on the bill up to max R120.00, with a minimum of 2 drinks
· Membership 2: 4th most expensive meal on the bill up to max R120.00, with a minimum of 4 drinks
Pre-authorisation is required in advance of ordering the meals. Authorisation is not a booking and is not a guarantee of a cashback refund. If required, a booking reservation should be made directly by the member with the restaurant.
Cashback claims:
1) must be submitted within one calendar month of the restaurant visit; and
2) must be deposited into the bank account in the name of the member only; and
3) must include the original restaurant receipt clearly displaying the restaurant name, receipt number, date, and time (card receipts not accepted). At Crave’s discretion, Crave may request proof of payment to be submitted along with any pro-forma invoices submitted, e.g. credit card slip, Zapper or Snapscan receipt, or cash receipt. Failure to produce proof of payment when requested may result in the claim being declined; and
4) will not be processed if the details on the receipt (restaurant name, date) do not match the authorisation details or if the proof of payment and authorisation time is more than 5 hours apart. Please request a new authorisation if a restaurant visit is rescheduled and falls out of this time. Backdated authorisations are not permitted.
Membership is non-transferable.
Crave accepts no responsibility for the quality of service and/or meals at restaurants. Furthermore, Crave will not become involved in any non-Crave related disputes between members and restaurants.
Crave processes and terms and conditions may be amended from time to time.
Failure to adhere to, or any attempt to circumvent the Crave Dining Cashback Benefit terms and conditions, will result in eligibility to use the Crave Dining Cashback Benefit being terminated.
CRAVE DINING VOUCHER
The Crave Dining Voucher Benefit utilizes Zapper to facilitate the discount. You are required to download and install the Zapper app onto a compatible smartphone in order to access the benefit. Zapper Terms & Conditions apply.
The Benefit entitles a Crave Dining Voucher member to buy one meal and get one free. Where both meals differ in price, the discount is calculated as 50% of the total cost of both meals, up to a maximum discount of R120.
You are required to spend a minimum of R300 to qualify for your discount.
You are required to pay using the Zapper app in order to redeem the benefit voucher and enable your discount.
Unless otherwise specified, voucher redemption may be used once per day per restaurant, and any unused redemptions may not be accumulated for that calendar month.
The Dining Voucher benefit can only be redeemed at restaurants available under the Dining Voucher restaurant selector on the a First Loyalty Plus) website.
The individual Dining Voucher partners reserve the right to determine whether or not the Dining Vouchers benefit may be used in conjunction with any other special offers, promotions, discount vouchers or loyalty programs.
CRAVE COFFEE VOUCHER
The Crave Coffee Voucher Benefit utilizes Zapper to facilitate the discount. You are required to download and install the Zapper app onto a compatible smartphone in order to access the benefit. Zapper Terms & Conditions apply.
The Benefit entitles a Crave Coffee Voucher member to buy one coffee and get one free. Where both coffees differ in price, the discount is calculated as 50% of the total cost of both coffees, up to a maximum discount of R25.
You are required to spend a minimum of R30 to qualify for your discount.
You are required to pay using the Zapper app in order to redeem the benefit voucher and enable your discount.
Unless otherwise specified, voucher redemption may be used once per day per restaurant, and any unused redemptions may not be accumulated for that calendar month.
The Coffee benefit can only be redeemed at restaurants available under the Coffee restaurant selector on the a First Loyalty Plus website.
The Coffee Voucher benefit is based on the on the restaurants standard prices and applies to individual menu items only.
The individual Coffee Voucher partners reserve the right to determine whether or not the Coffee Vouchers benefit may be used in conjunction with any other special offers, promotions, discount vouchers or loyalty programs.
The Coffee Voucher benefit cannot be used in conjunction with the Dining benefit or the Dining Voucher benefit.
2-4-1 MOVIES
2-4-1- Movies codes can only be purchased by South African residents via the First Loyalty Plus website.
Members receive a pre-determined discount off the retail purchase price of movie tickets at Nu Metro. Ster-Kinekor and CineCentre theatres.
Members are limited to purchasing 2 (two) x 2D movie codes and 2 (two) x 3D movies codes per calendar month.
Once the member purchases the required number of movie codes from the First Loyalty Plus website, the codes will be sent via SMS to the main member’s cellphone number and these codes can be redeemed at any of the participating movie theatres.
The movie code cannot be redeemed for cash.
Any booking of tickets is not refundable.
If a member’s online booking requests cannot be confirmed then they must contact First Loyalty Plus on 0872 100 398 for assistance.
This offer does not include any iMax, 4D, Prestige, Scene Xtreme, Scene VIP movies.
In order to purchase discounted movies, members require a Visa or MasterCard credit card.
The following cinemas will no longer be accepting 2D or 3D movie codes: Nu Metro Hyde Park, Nu Metro Parkview Centre and Nu Metro Bedford.
Vouchers are valid for 3 (three) years from the date of issue.
“NEXT” - means NEXT Engage Pty Ltd (registration number 2003/002780/07)
NEXT will not be held liable in the event that a Member’s purchased movie codes show as redeemed by Nu Metro, Ster-Kinekor or CineCentre prior to the member utilising their codes unless the Member has irrefutable proof that the codes were not redeemed by the Member in question.
NEXT will not be liable for any loss, expenses, claim(s) or damage, whether direct, indirect or consequential, arising from the use of 2-4-1 Movies and the member accordingly indemnifies NEXT against any such losses, expenses, claim(s) or damages, provided that such loss was not suffered due to the negligence of NEXT.
NEXT reserves the right to change the NEXT partner/s that provide the benefits to the First Loyalty Plus programme based on member usage, pricing, quality, availability of service or at NEXT’s sole discretion.
2-4-1 COOLDRINK AND POPCORN
2-4-1 Cooldrink and Popcorn codes can only be purchased by South African residents via the First Loyalty Plus website.
Members receive a pre-determined discount off the retail purchase price of Nu Metro and Ster-Kinekor regular cooldrink and popcorn combos.
Members are limited to purchasing 4 (four) cooldrink and popcorn codes per calendar month.
Once the member purchases the required number of cooldrink and popcorn codes from the Vaczone website, the codes will be sent via SMS to the main member’s cellphone number and these codes can be redeemed at any of the participating movie theatres.
The cooldrink and popcorn codes cannot be redeemed for cash.
The popcorn and coke codes validity date will be stipulated on the SMS sent to the member.
Online payments are not refundable.
If your online booking requests cannot be confirmed then please contact First Loyalty Plus on 0872 100 398 for assistance.
In order to purchase cooldrink and popcorn codes, members require a Visa or MasterCard credit card.

NEXT will not be held liable in the event that a Member’s purchased cooldrink and popcorn codes show as redeemed by Nu Metro, Ster-Kinekor or CineCentre prior to the member utilising their codes unless the Member has irrefutable proof that the codes were not redeemed by the Member in question.
NEXT will not be liable for any loss, expenses, claim(s) or damage, whether direct, indirect or consequential, arising from the use of 2-4-1 Cooldrink and Popcorn and the member accordingly indemnifies NEXT against any such losses, expenses, claim(s) or damages, provided that such loss was not suffered due to the negligence of NEXT.
NEXT reserves the right to change the NEXT partner/s that provide the benefits to the First Loyalty Plus programme based on member usage, pricing, quality, availability of service or at NEXT’s sole discretion.
MEMBERSHIP TERMINATION
We reserve the right to terminate the membership of any member that we, in our sole discretion, reasonably believe is using the Program in a manner that violates these Terms of Service, has acted in a manner inconsistent with applicable laws, ordinances or regulations, or has engaged in fraud or abuse concerning Rewards or membership privileges and benefits. If fraudulent activity is discovered, we reserve the right to take necessary legal action. In addition, you may be liable to us for monetary losses, including litigation costs and damages, and you will not be allowed future participation in the Program.
We reserve the right to terminate the membership of any member if their membership account has shown no activity for a period of twelve months.
We reserve the right to terminate the membership of any member that has failed to pay the relevant monthly membership fee, and or any monies owing, and is more than 21 days in arrears.
You may terminate your membership by providing a First Loyalty Plus with twenty-one day written notice. Such written notice must be sent info@firstloyaltyplus.co.za, using the email account associated with your membership account, and explicitly state that you wish to terminate or cancel your membership. Should the first of the month fall within the twenty-one day notice period then you shall be charged an additional monthly membership fee. You shall have twenty-one days from the date the written notice is sent in which to use any Rewards balances.
In the event that your membership is terminated your account will be closed and all Rewards in the account are subject to forfeit.
Should your membership be cancelled then you may have your membership reinstated at any time by pay a once-off re-activation fee equal to that of the current once-off joining fee. All reinstatements are subject to approval and we reserve the right to deny any reinstatements. Upon reinstatement we reserve the right to credit your account with any Rewards balances which may have been forfeited at the time of termination or to award you with any additional Rewards
TERMINATION OF PROGRAM
The Program has no predetermined termination date and may continue until such time as we decide to terminate the Program.
We may terminate the Program at any time. Upon termination, you will have ninety days from the date the Program termination is announced to use any available Rewards remaining in your account. After that date, any Rewards balances will be forfeited without compensation.
HOLIDAY VOUCHERS
Any holiday vouchers purchased from the a First Loyalty Plus Store included with any purchase from the a First Loyalty Plus Store or awarded as a competition prize, entitle the bearer to a specified number of nights in fully furnished and serviced accommodation for a specified number of guests at one the specified resorts. The vouchers are for accommodation only.
Holiday vouchers purchased from the a First Loyalty Plus Store or included with any purchase from the a First Loyalty Plus Store are valid for 12 months from date of issue. Holiday vouchers awarded as a competition prize are valid for 12 months from the date of issue.
All holiday vouchers are subject to availability and are not transferable, may not be redeemed for cash and have no cash value.
Holiday voucher reservations requests may only be made for occupancy dates 6 weeks in advance. Reservations may not be made during peak and public holiday periods. All reservations to be requested by phone or email.
To redeem a holiday voucher call 031 717 7622 or email debbiekr@clubleisure.co.za to request dates and resorts. Upon confirming the accommodation, a confirmation certificate will be sent to you which must be presented at the resort when checking in, together with your ID document. All accommodation is subject to the resort's occupancy rules with the understanding that in a:
2 Sleeper Studio, all guests are accommodated in an open plan living area.
4 Sleeper 1 Bedroom Suite, 2 guests are accommodated in a separate bedroom and 2 guests may are accommodated in the living area on a sleeper couch.
6 Sleeper 2 Bedroom Suite, 4 guests are accommodated in two separate bedrooms and 2 guests are accommodated in the living area on a sleeper couch.
Once the confirmation certificate has been issued there can be no refunds or exchanges, however, should you so desire the confirmation certificate can be reissued in the name of another guest
SPA VOUCHERS
Any holiday vouchers purchased from the a First Loyalty Plus Store, included with any purchase from the a First Loyalty Plus Store, or awarded as a competition prize, can be enjoyed at any of the La Vita Spas countrywide.
Spa vouchers purchased from the a First Loyalty Plus Store or included with any purchase from the a First Loyalty Plus Store are valid for 12 months from the date of issue. Spa vouchers awarded as a competition prize are valid for 12 months from the date of issue.
Spa vouchers cannot be refunded or exchanged for cash or other denominated vouchers or products. However, they should be treated like cash as they cannot be replaced if lost or stolen.
Spa vouchers which are defaced, altered or cancelled will not be accepted.
If a selected treatment is for a higher amount than the face value of the spa voucher, then the difference can be made up with cash. If a purchase is for a lower amount, no change can be given.
Spa vouchers cannot be used in conjunction with any special promotions.
Present your spa voucher in advance to redeem it. Unless specifically specified, all spa vouchers are limited to use by one person only. Bookings are essential.
REFUND AND RETURN
Any product ordered from the a First Loyalty Plus Store shall eligible for a refund if the product is not received with 60 days from the date of order, if the product is defective, if the product is significantly different to the description and/or image(s) on the Website, and only if your account with a First Loyalty Plus is in good standing.
Products shall not be eligible for a refund if the product did not arrive due to you providing us with the incorrect delivery information, if you claim that a product is defective but the supplier can prove that it is not defective, the product is as described but you no longer want it, if your account with a First Loyalty Plus is not in good standing, and if the product is returned to the supplier due to your refusal to pay any custom duties.
You may request a refund by sending an email to info@firstloyaltyplus.co.za with the details as to why you would like a refund. Such refund request must be submitted to us within 14 days of you receiving the product. Any refund request submitted after 14 days of you receiving the product will no longer be eligible for a refund.
Once your refund request has been investigated and approved, you may choose to either keep the product and receive a partial refund, or return the product at your cost and receive a full refund.
LEGAL JURISDICTION
In the event that any portion of this agreement is held to be unlawful or unenforceable, such portion will be deemed deleted from this agreement in the applicable jurisdiction, and the remaining provisions will remain in force. All disputes which cannot be resolved between the parties, and causes of action arising out of, or connected with this agreement shall be resolved individually, without resort to any form of class action.
We reserve the right but are not obligated, to limit the sales of our products and services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer.
These Terms of Service shall be construed in accordance with, and governed by, the laws of the Republic of South Africa and the State of Washington.
MODIFICATION OF TERMS OF SERVICE
Any new features or tools which are added to the Website shall also be subject to this agreement. We reserve the right to modify this agreement from time to time. It is your responsibility to check this agreement periodically for changes.
Modifications may be reviewed by clicking on the “Terms of Service” tab located in the footer of the Website. Any updated version of this agreement will supersede all previous versions of this agreement. By continuing to use the service after we post any such modifications, you accept this agreement, as modified. You agree to take responsibility for being aware of the current Terms of Service.
We reserve the right to modify, cancel, suspend or terminate the Program, the use of any supplier, the use of any service, and to change fees at any time, with or without notice to you, even though your ability to use any Rewards or benefits available to you may be affected. Modifications may include, but are not limited to; the rules for earning and redeeming Rewards; the expiration policy for Rewards; and the products and services for which Rewards may be used. Your continued participation in the Program maintains acceptance of any and all such changes. However, once your Rewards has been redeemed, all specifications are set and are not subject to change.
We may run promotions from time to time that provides enhanced benefits to select members, based on membership levels. Any additional terms, conditions, policies, and notices which form part of these promotions will be in effect for the duration of the promotion, and by engaging with these promotions you accept these additional terms, conditions, policies, and notices.
MODIFICATIONS TO THE SERVICE AND PRICES
Prices for our products and services are subject to change without notice. We reserve the right at any time to modify or discontinue any product or service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of any products or services.
WARRANTIES AND GUARANTEES
We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.
